These Terms of Service (āTermsā) govern access to and use of WhatsApp ā Claude bot (the āServiceā), provided by [Company Name] (āweā, āusā, āourā).
If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity. If you do not agree to these Terms, do not use the Service.
1) Definitions
- Bot Owner: the customer account holder who configures and operates the bot for one or more WhatsApp groups/DM use.
- End User: any person interacting with the bot in a WhatsApp chat (group or 1:1 DM).
- Customer Content: messages, media, configuration text/prompts, and other content submitted via WhatsApp or dashboards.
2) The Service
The Service enables a WhatsApp bot experience that can receive messages in eligible chats and generate responses using AI providers. Optional features may include media handling (images/audio) and voice transcription/synthesis, as well as web dashboards.
3) Important WhatsApp notice (unofficial connection; account risk)
The Service connects to WhatsApp using an unofficial WhatsApp Web connection. This may be incompatible with WhatsAppās terms or technical restrictions and may result in temporary or permanent account limitations or bans for the phone number/session used.
- WhatsApp is a third-party service outside our control.
- We do not guarantee uninterrupted availability or continued compatibility with WhatsApp.
- You are responsible for ensuring your use complies with WhatsAppās terms and applicable law.
4) Eligibility and accounts
You must be able to form a binding contract in your jurisdiction. If you use dashboards, keep credentials secure and information accurate.
5) Acceptable use
You agree not to use the Service to:
- violate any law or third-party rights;
- send or solicit illegal content, malware, or abusive/harassing content;
- attempt to bypass security controls or access data you are not authorized to access;
- scrape, harvest, or bulk-export personal data from WhatsApp groups using the Service;
- materially degrade or interfere with the Service or third-party services.
We may suspend or terminate access if we reasonably believe there is a violation, an abuse/safety risk, or a security incident.
6) Bot Owner responsibilities
Bot Owners are responsible for transparency and notices to group participants, obtaining permissions/consents where required (including voice/media), and ensuring configurations/prompts and intended use are lawful.
7) Customer Content and licenses
You retain ownership of Customer Content. You grant us a non-exclusive, worldwide license to host, store, reproduce, process, and transmit Customer Content solely to provide, maintain, secure, and improve the Service, including sending relevant content to providers (AI/voice) to generate responses.
8) AI output disclaimer
AI-generated outputs may be inaccurate or inappropriate. The Service is not professional advice (legal, medical, financial, safety). Evaluate outputs before relying on them.
9) Privacy
Our Privacy Policy describes how we process personal data and is incorporated by reference into these Terms.
10) Security
You are responsible for maintaining the security of your environments and credentials. WhatsApp session/auth files are sensitive; anyone with access can hijack the WhatsApp session.
11) Fees, billing, and taxes (if applicable)
Pricing/limits/billing cadence will be described at checkout or in an order form. Fees are non-refundable except where required by law.
12) Suspension and termination
We may suspend or terminate access for violations, security/safety reasons, legal requirements, or if third-party platform access is restricted. You may stop using the Service at any time.
13) Intellectual property
We and our licensors own the Service and related IP, excluding Customer Content. No rights are granted except as expressly stated.
14) Disclaimers
THE SERVICE IS PROVIDED āAS ISā AND āAS AVAILABLEā. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES.
15) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT/CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE 3 MONTHS BEFORE THE EVENT, OR EUR 100 IF NO FEES WERE PAID.
16) Indemnity (business use)
If you use the Service in a business context, you agree to indemnify and hold us harmless from claims arising out of unlawful use or Customer Content.
17) Changes
We may update these Terms from time to time and will update the āLast updatedā date.
18) Governing law and venue
